USecure Locksmith & Access Control is an operating name of USecure Locksmith Services Ltd. References to “USecure,” “we,” “us” or “our” mean USecure Locksmith Services Ltd. operating as USecure Locksmith & Access Control.
Estimates, scope and authorization
Estimates are based on the information available at the time they are prepared. Final pricing and scope may change if site conditions, existing hardware, wiring, door or frame condition, code requirements, access limitations, customer instructions or product availability differ from what was expected.
By requesting or authorizing service, you confirm that you have the authority to request work at the property and to approve the related charges. USecure may refuse or stop work where authorization, safety, payment, access or legal concerns arise.
Payment terms
Payment is due by the due date shown on the invoice. If an invoice does not show a due date, payment is due upon receipt unless USecure agrees otherwise in writing.
USecure accepts payment by cash, cheque, credit card, bank transfer or other approved payment method. A 2% processing fee may be applied to credit-card payments.
Late payments may be subject to interest at 1.5% per month, or the maximum amount permitted by applicable law if lower. The customer is responsible for reasonable costs incurred to collect overdue accounts, including collection costs, court costs and legal fees, where permitted by law.
Invoice disputes
Any invoice dispute must be sent to USecure in writing within seven days after receiving the invoice. The notice should identify the invoice, the disputed amount and the reason for the dispute. Undisputed amounts remain payable when due.
Service conditions
Door, lock, access-control, automatic-door, intercom, CCTV and related security work can depend on existing site conditions. USecure is not responsible for pre-existing defects, hidden damage, unsuitable customer-supplied hardware, building movement, electrical or network issues, third-party system limitations, unavailable parts, manufacturer changes, or conditions outside USecure’s control.
Customer-supplied products, used hardware, existing wiring, existing credentials, existing keys and third-party systems are not guaranteed unless USecure expressly agrees otherwise in writing.
Access, keys, credentials and security information
You are responsible for providing accurate access instructions and for authorizing any person who communicates with USecure about keys, credentials, locks, doors, codes, system access or security-sensitive information. USecure may take reasonable steps to verify authorization but is not responsible for losses caused by inaccurate, incomplete or unauthorized instructions provided by a customer, property representative or person reasonably appearing to act for the property.
Limited warranty
USecure will make reasonable efforts to perform services in a professional manner. Product warranties, if any, are provided by the manufacturer unless USecure states a separate written warranty. Warranty coverage does not apply to misuse, abuse, vandalism, attempted break-ins, normal wear, environmental damage, improper use, unauthorized modification, unrelated door or frame problems, third-party work, power issues, network issues or customer-supplied products.
Limitation of liability
To the maximum extent permitted by applicable law, USecure’s liability for any claim related to an estimate, invoice, service call, project, product, installation, repair, recommendation, delay, access issue, security issue or website use is limited to the amount paid to USecure for the specific service giving rise to the claim.
To the maximum extent permitted by applicable law, USecure is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, loss of business, loss of use, loss of data, loss of access, loss of security, lost rent, business interruption, reputational harm, replacement contractor costs, or claims by third parties.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Canadian or Ontario law.
